What's EB-5 Program

The EB-5 Program (Employment-Based Fifth Preference) is a U.S. immigration program that provides a pathway for foreign nationals to obtain U.S. permanent residency (a Green Card) by making a significant investment in a U.S. business that creates jobs for U.S. workers.

The EB5 application process details below:

Filing from outside of the United States
  • 1Prepare proof of source of funds:

  • Select project
  • Sign the Immigration Services Agreement
  • Sign the project subscription agreement
  • Prepare proof of legal source of funds and EB5 application documents
  • Transfer funds to project account

  • 2Submit I-526 application to USCIS

  • 3I-526 processing & approval:

  • Respond to the Immigration Bureau’s request for additional information
  • Obtain I-526 Approval

  • 4Submit visa application:

  • Submit DS-260 immigrant visa application
  • Submit civil documents to the US Visa Center NVC

  • 5Visa approved:

  • Take a physical examination
  • Attend an interview in the U.S. Consulate
  • Obtain an immigrant visa

  • 6Land in the United States:

  • Obtain a two-year conditional green card (temporary green card)

  • 7Submit I-829 application:

  • Submit I-829 to remove green card conditions

  • 8Obtain a permanent green card

  • Select project

  • 2Submit I-526 and I-485 applications:

  • If the investment category is not scheduled, submit I-526, I-485, I-131 and I-765 applications at the same time

  • 3Approval of work permit:

  • Fingerprint
  • Obtain I-131 reentry paper and I-765 work permit

  • 4Obtain a conditional green card:

  • Green card interview
  • I-526 approved
  • I-485 approved, obtained a 2-year conditional green card (temporary green card)

  • 5Submit I-829 application:

  • Submit I-829 to remove green card conditions

  • 6Obtain a permanent green card
